ðŸŠķ PartyBird Terms & Conditions

Last updated: October 2025

Welcome to PartyBird, operated by Origami Kraken Co. ("we," "us," or "our"). By using PartyBird (the "Service"), you agree to these Terms. Please read them carefully — they explain what you can expect from us and what we expect from you.

1. What PartyBird Does

PartyBird lets you create, send, and manage online event invitations ("events") — from small get-togethers to large business functions. Some features are free forever; others are part of paid subscription tiers for extra power or scale.

2. Who Can Use PartyBird

  • You need to be at least 13 years old (or the legal minimum age in your country) to use PartyBird.
  • If you're using PartyBird on behalf of a company or organization, you confirm you have permission to do so.

3. Your Account

  • You're responsible for keeping your account details secure and for anything that happens under it.
  • If you suspect unauthorized activity, please contact hey@partybird.app right away.

4. Your Content

You own everything you create — event titles, images, photos, comments, and messages ("Your Content").

  • By posting or sending Your Content through PartyBird, you grant us a limited license to host, display, and share it as needed to run the Service (for example, to show invites to guests).
  • Some events are visible to anyone with the link; others may be private or password-protected. Choose the option that fits your needs.
  • You agree not to upload or share anything unlawful, hateful, or that infringes on someone else's rights. We may remove content or suspend accounts that break these rules.

5. Payments and Subscriptions

Free users can access the core invite and RSVP tools at no cost.

If you choose a paid plan or add-on (for advanced customization, business features, or paid events):

  • Payments are processed securely by Stripe or another third-party processor — we don't store credit-card data.
  • Fees, renewal periods, and cancellation terms are shown at checkout.
  • You can cancel anytime; your subscription stays active until the end of the billing period.
  • If you use PartyBird to collect money for tickets or events, you're responsible for complying with any applicable tax or legal obligations.

6. Communication

  • We'll send you transactional emails (like invitations, RSVP updates, or billing notices).
  • Occasionally we may send marketing or update emails — you can opt out anytime using the unsubscribe link.

7. Third-Party Tools

PartyBird integrates with or relies on trusted partners, including:

  • Canva API – for design tools
  • Stripe – for payments
  • PayPal – for voluntary donations ("Buy Me a Coffee")
  • Google Analytics – for usage analytics
  • Resend – for email delivery

Those providers have their own terms and privacy policies. By using their features within PartyBird, you also agree to their rules.

8. Service Changes

  • We're constantly improving. We may update, add, or remove features at any time.
  • If a change significantly affects you, we'll give reasonable notice by email or in-app message.

9. Liability & Disclaimer

  • PartyBird is provided "as is." We do our best to keep it secure and reliable, but we can't guarantee uninterrupted access.
  • We're not responsible for losses caused by events outside our control — like service outages, data breaches of third-party providers, or misuse by other users.
  • To the extent allowed by law, our total liability to you for any claim is limited to what you paid us in the past 12 months (if anything).

10. Termination

  • You can close your account anytime.
  • We may suspend or terminate accounts that violate these Terms or abuse the platform.

11. Governing Law

  • These Terms are governed by the laws of the State of California, USA.
  • Any disputes will be handled in California courts.
